The Appellant has forwarded request for information filed under the defunct Freedom of Information Ordinance 2002 along with the response of the public body denying access to the requested information under Section 8 of the repealed Freedom of Information Ordinance 2002.
This commission cannot take cognizance of the appeal as it is time-barred under Section 17 (1) of the Right of Access to Information Act 2017.
Ordinarily, this commission gives Leeway to the Appellants in exercising their constitutional right of Access to Information, but in the case of instant appeal, the requirements of the due process of law dictate that the Appellant exercise of his right to information under the Right of Access to Information 2017 so that the public body could submit its response under the provisions of this Act.
