This Commission held that the Information requested in the instant appeal is the category of record and information that falls within the definition of the Public record and the public body is under obligations to duly publish and uploads it over the Internet as mandated under Section 5 of the Act.
The appellant has the legal and statutory right under the Right of Access to Information Act, 2017 and Constitutional Right under the Article 19(A) of the Constitution of Islamic Republic of Pakistan to have access to the requested information and record. This right can’t be withheld or delayed by the bureaucratic hierarchy by using the delaying tactics.
