The appellant, an Overseas Employees Promoter has sought promotion documents of another Overseas Employment Promoter pertaining to the recruitment of 350 workers for Poland. The request is declined for the reasons that demand documents of Overseas Employment Promoter is not a public record as the same is agreed and signed privately between the Overseas Employment Promoter and the Foreign Employer under the Immigration Rule 1979. If allowed it is likely to constitute an actionable breach of trust and confidence and would prejudice the commercial and financial interest of the third party.
